A five-judge constitution bench comprising Justices S Abdul Nazeer, BR Gavai, AS Bopanna, V Ramasubramanian and BV Nagarathna dismissed a batch of 58 petitions challenging the Centre’s 2016 decision to demonetise currency and said that the decision, being part of the Executive's economic policy, cannot be reversed. The majority decision by the constitution bench headed by Justice S A Nazeer, said the Centre's decision-making process could not have been flawed as there was consultation between the Reserve Bank of India (RBI) and the Union government. There was a reasonable nexus to bring such a measure, and we hold that demonetisation was not hit by the doctrine of proportionality, the SC said. As the 4-1 majority judgement didn't find any flaw in demonetization process and the court was convinced that GOI and RBI were in consultation about the proposal dating back six months prior to November 8, 2016 going by the nation's tradition of respecting judicial decisions, common man expects a closure of the debate on the subject except for academic and political purposes. Irrespective of what happens to gold prices in the international market, India should go ahead and grab the emerging opportunity to stake the country's claim to its proud position as on among the top nations with substantial domestic gold stock. Government decision to explore the possibility of reviving Kolar mines and the unsaid proposal to explore the potential of yet to be mainstreamed and to be accounted domestic gold stock estimated at 24,000 tons will change the country's image as a fast growing economy. The present global gold scenario gives India a once in a lifetime opportunity to quickly redeploy a part of the country's idle domestic gold stock for productive use. Illustratively, if one-fifth of the estimated 24,000 tonnes of the stock can be mainstreamed and accounted, over a period of next five years, import of gold will come down substantially. Impact will be two-way. One, as those who invest their gold will earn at least 2 percent per annum on their gold investment and there will be foreign exchange savings to the extent gold imports come down. There will be other long term benefits also for the nation's economy. All these will become more feasible and socially acceptable, once a gold hubb of international reputation develops around Kolar gold fields with state of the art facilities for gold management "from mines to market". Standardization, mainstreaming and accounting, as also creating awareness among the people of India about gold as a productive investment option, besides "store of value", will improve the chances of India's faster economic growth during the current decade. Simultaneously, making necessary changes in the Banking Regulation Act to encourage banks to hold a portion of the liquid assets in gold will improve the return on gold deposits. M G Warrier Mumbai E Collage Story : Shared by R Jayakumar Technology and humanity* I got up from the bed, suddenly my chest started hurting. Do I have a heart problem? With such thoughts in mind, I went to the living room next door. I saw that my whole family was busy on their mobile phones. I looked at my wife and said, "My chest is hurting a little more than usual today, I'll go and see the doctor." "Yes, but be careful, and call if you need something," she said while still looking at her phone. The rest of the family was completely unaware of this. I reached the parking lot with the Activa keys. I was sweating a lot, and the two wheeler would just not start. Just then, our household helper Dhruv reached there on bicycle. He locked the cycle and saw me standing there, so he said, "What happened sir, is the Activa not starting?" I said, "No..!!" "You don't seem well, Sir. Why are you sweating so much? Sir don't kick the scooty in this condition, I'll kick-start it." Dhruv started the Activa with a single kick. And then he asked, "Sir are you going alone?" I said, "Yes." He said, "Don't go alone in this condition. Come, sit behind me." I said, "Do you know how to drive an Activa?" "Sir, I have a license for big cars as well, don't worry and sit behind me." We reached a nearby hospital. Dhruv ran inside and came out with a wheel chair, "Sir, do not walk, sit on this chair." Dhruv's mobile phone kept ringing. I had understood that everyone would be calling him from the flats, asking why he hadn't come till now.. Dhruv finally got tired and told someone, "I can't come today." The way Dhruv was behaving with the doctor, he had figured out without being told that Sir was suffering from a heart problem. He took the wheel chair in the lift, towards the ICU. The team of doctors was ready, having heard of my problem. All the tests were done quickly. The doctor said, "You have reached on time, and then you have been very wise in using a wheel chair. Now it is very dangerous for you to wait for anyone, so without any delay, we have to operate on your heart and remove the blockages soon. Your relative's signature is required on this form." The doctor looked at Dhruv. I said, "Son, do you know how to sign?" He said, "Sir, don't put such a big responsibility on me." "Son, you have no responsibility. Even though there is no blood relation with you, yet you have fulfilled your responsibility without saying. It was actually my family's responsibility. So now fulfill one more responsibility, son. I will sign below and write that if anything happens to me, it is my responsibility. Dhruv has signed only on my request. Please just do it... and yes, call home and inform them." Just then, my wife called Dhruv. He calmly listened to what she was saying. After a while Dhruv said, "Madam, if you want to cut the salary, then do it; if you want to fire me, then you can do that. But just now, reach the hospital before the operation starts. Yes Madam, I have brought Sir to the hospital, the doctor has prepared for the operation and they've said not to wait anymore now." I said, "Son, was it a call from my home?" "Yes sir." I thought about my wife...whose salary was she thinking of deducting, and who was she going to fire? With tears in my eyes, I placed my hand on Dhruv's shoulder and said, "Don't worry son. I serve in an organization that supports elderly people, and they need people like you. You are not meant to do laundry, or wash utensils etc. Your work is to do social service. And son you will get salary, so don't worry at all." After the operation I regained consciousness. My whole family was standing in front of me with bowed heads. I said with tears in my eyes, "Where is Dhruv?" My wife said, "He took leave and left for his village just now. He was saying that his father has passed away from heart attack, he will come back after 15 days." Now I understood that he must be seeing his father in me. O Lord, give him courage. The whole family was apologizing with folded hands, silent, heads bowing down. How far away the addiction of mobile phones, can take a person from his heart, from his family, from his existence! The doctor came and said, "First of all, tell me how is Dhruv related to you?" I said, "Doctor, it would be better not to go into the names or depth of some relations. That will maintain the dignity of the relationship, all I can say is that he came as an angel to me in an emergency." Pintu said, "Forgive us, Papa, Dhruv has fulfilled the duty which was actually ours, we're really ashamed of that. Such a mistake will never be repeated again, Papa." "Son, we are all so caught up in technology today that we are not able to feel the pain of our loved ones around us. An inanimate toy has enslaved us living beings. Now the time has come to use it sparingly. Otherwise... not only families, society and the nation, but the whole world will have to face its dire consequences and be ready to pay the price." *If you think it's a repeat, may be. Don't go through life beating yourself up, thinking about everything you've done wrong, dwelling on your mistakes and failures. When you make a mistake, and become aware of your mistake, feel sorry, seek forgiveness from the affected and then move on. Don't keep bringing up the same failures. How long are you going to let the accuser keep you feeling guilty and condemned? The first time you asked for forgiveness, you were not only forgiven, but the person who forgave you doesn't remember it any more. If you ask forgiveness again for the same thing, his reply would be , "What are you talking about? I have no record of that. When I forgave you, I deleted your files." No one has a big server or memory large enough for keeping a backup copy just in case he changes his mind. This is a new day. Enter into the joy of knowing that we are here to live a happy, healthy and peaceful life and our record is clear- -no judgment, no condemnation.
