Retro Tax
This refers to your brief editorial "We Dig Federalism, But Why Retro Tax?" (Economic Times, August 16) which covers multiple impacts of the Apex Court verdict on mining tax. The ruling naturally will trigger relationship issues between Centre and states and the impact of retrospective taxation on the finances of tax-paying entities irrespective of their ownership will be severe.
In the instant case, may be, a substantial portion of the burden will be in the nature of transfer of funds from public sector entities to governments, both getting converted into rise in prices of products dependent on mined resources especially coal.
The message that the responsibility to pay taxes can get postponed indefinitely may not augur well in a situation where political leadership in states and Centre can change at 5 years or shorter intervals. Perhaps all these issues might have been considered by the Hon'ble Lordships before coming to conclusions. Still, possibility of destabilisation of finances of a sector crucial to economic development is scaring.
